Highland Kings — Terms of Service

Welcome to Highland Kings. These Terms of Service (“Terms”) set out the legal terms that apply when you use our website highlandkings.co.uk and buy products from Highland Kings (a trading name of Team Bearclaws Ltd). By using our site or placing an order you accept these Terms.

If you do not agree, please do not use our site or place an order. If you need a short plain-English summary for product pages, say the word and I’ll make one.

1. Who we are

Highland Kings is the online retail brand for heritage and bespoke printed products produced and fulfilled by Printify and its network of production partners. Highland Kings is a trading name of Team Bearclaws Ltd, registered in Scotland.

2. Age and account eligibility

By placing an order you confirm that you have the legal capacity to enter into a binding contract. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms and has authorised the purchase. Highland Kings (Team Bearclaws Ltd) reserves the right to cancel or refuse orders where we reasonably suspect a purchaser lacks the legal capacity to contract.

3. Orders, acceptance and confirmation

When you place an order you will receive an order confirmation by email. This is an acknowledgement of your order only and does not mean we have accepted it.

We accept your order when we send you a dispatch confirmation email or, if the product is a digital download, when the download link is made available. We may refuse or cancel an order for reasons including errors in product information, suspected fraud, or where a product is no longer available.

4. Production & fulfilment (Printify)

Most Highland Kings products are made-to-order and printed/fulfilled by Printify or Printify production partners.

  • Production times, shipping estimates and delivery responsibilities are described on our product pages. Production and shipping times are estimates only and may vary due to demand, supplier schedules, customs, or carrier delays.

  • For manufacturing faults, incorrect items, or damage please follow our Returns & Refund Policy. We will submit claims to Printify on your behalf where appropriate.

  • We are not responsible for delays caused by Printify, the carrier, customs, or any third party beyond our direct control. Where a third-party fulfilment partner provides remedies (reprint, refund), we will apply those remedies as received.

5. Pricing & payment

All prices are shown in pounds sterling (GBP) and include VAT where applicable. We reserve the right to change prices at any time, but price changes will not affect orders already accepted.

We accept payment by major credit/debit cards and other payment methods displayed at checkout (for example PayPal). Payment is taken at the point of order. By providing payment details you confirm you are authorised to use the chosen payment method.

6. Personalised & bespoke items

Many Highland Kings products are personalised (for example surname crests). Personalised items are produced to your specification and, under UK consumer law, the right to cancel (cooling-off period) does not usually apply to bespoke or personalised goods. Please check product pages carefully before ordering.

If a personalised product arrives faulty or not as described we will investigate and work with Printify to offer a reprint or refund where appropriate.

7. Shipping, delivery & risk

Risk of damage passes to you when the carrier delivers the product to the delivery address provided. Delivery dates are estimates only. If an item is lost or marked as delivered but you have not received it, contact us and we will investigate and liaise with Printify/carrier on your behalf.

8. Returns & refunds

Please refer to our separate Returns & Refund Policy for full details. Short version: faulty or incorrectly produced items are eligible for investigation and remedy; change-of-mind returns for personalised products are generally not accepted.

9. Product descriptions & images

We make every effort to accurately describe our products. However, colours shown online may vary slightly from the physical product due to screen settings and printing differences. Sizes are approximate. Minor variations in print positioning or finish (normal for made-to-order items) are not defects.

10. Intellectual property

All content on highlandkings.co.uk — including images, designs, logos, text and product artwork — is owned or licensed by Team Bearclaws Ltd and protected by copyright, trademark and other intellectual property laws. You may not reproduce, distribute, modify or create derivative works from our content without prior written consent.

If you submit custom artwork to be printed you confirm you own the rights to that artwork or have permission to use it. We reserve the right to refuse to print content that infringes third-party rights or violates these Terms.

11. User content and reviews

If you post reviews, photos, or other content to our site or social channels you grant Highland Kings a royalty-free, worldwide licence to use, reproduce and display that content for marketing and promotional purposes. Do not submit content that is unlawful, abusive, or infringes others’ rights.

12. Prohibited use

You must not use our site or services to upload or make available content that is illegal, defamatory, pornographic, hateful, or infringes intellectual property rights. We may remove content and suspend accounts that violate these rules.

13. Liability & disclaimers

To the fullest extent permitted by law:

  • We supply products for domestic and private use only. We will not be liable for loss of business, profits, revenue, goodwill or similar indirect losses.

  • Our total liability to you for any claim arising out of or in connection with these Terms shall be limited to the value of the relevant order (excluding delivery).

  • Nothing in these Terms seeks to exclude or limit liability for death or personal injury caused by our negligence, or for fraud, or any other liability which cannot be excluded under applicable law.

14. Indemnity

You agree to indemnify and hold Highland Kings and Team Bearclaws Ltd harmless from any claims, loss, damages, liabilities, costs or expenses arising from your breach of these Terms, your use of the site, or any user-submitted content.

15. Data protection & privacy

We process personal data in accordance with our Privacy Policy. By using our site you consent to the collection and use of information as described in that policy. If you need details on how we handle data or want to exercise data rights please see our Privacy Policy or contact support@highlandkings.co.uk.

16. Third party sites and services

Our site may contain links to third-party websites (for example marketplaces or Printify). We are not responsible for the content or practices of those sites. If you buy via a marketplace, that marketplace’s terms and buyer protections may apply in addition to these Terms.

17. Suspension and termination

We may suspend or terminate access to your account or refuse service if you breach these Terms, if we suspect fraudulent activity, or to comply with legal obligations. Termination does not affect accrued rights or liabilities.

18. Changes to these Terms

We may amend these Terms at any time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of the site after changes constitutes acceptance of the updated Terms.

19. Governing law and jurisdiction

These Terms are governed by the laws of Scotland and the courts of Scotland have exclusive jurisdiction for any dispute arising under these Terms, to the extent permitted by law.
